The strong desire to enter the USA in search of the better life is not enough for receiving the status of the refugee. This status is given only to persons who are pursued in their country on one or several specified bases. The USA gives a political asylum to Un Orthodox Christians (Pentecostals, Baptists, Adventists, etc.) which are suffered of discriminations and persecutions. According to US State department, the negative altitude to Un Orthodox Christians is privately supported by the state structures of CIS countries. So, Christians-Protestants have the serious bases to receive a political asylum from the government of the USA.
Thus, the political asylum in the USA on «a religious line» is real possibility for Un Orthodox Christians. To receive a political asylum in the USA, the applicant should prove the serious bases of the fear to undergo to reprisals and discrimination if he would return back to the country. The law defines prosecutions by many parameters, for example physical attacks, a beating, traumas, imprisonment, interrogations, deprivation of work and apartment, car damage and so on.
Lautenberg Amendment, which was accepted by the USA Congress, confirms that Jews and Evangelical Christians from the former Soviet Union have to be considered as the potential purposes for religious prosecutions and persecutions in the CIS countries. Based on this amendment, religious minority have serious advantage in obtaining a political asylum in the USA.
As a result, the applicant should correspond to all criteria’s listed low:
1. The person must be the refugee in the law understanding;
2. The person must belong to the Jewish nationality or to be the follower of Evangelical Christians, Ukrainian Greco-Catholic Church or the Ukrainian Orthodox Church.
3. The person must not have a constant residence in other country after leaving the native land;
4. The person must not have obstacles for entrance to the USA.
5. The person must not have previous convictions of crimes in the past.
